The General Terms and Conditions apply to all online sales by Anthony Garçon of clothing and accessories (the "Products") offered on the website https://anthonygarcon.com (the "Site") to any natural person wishing to make a purchase via the Site (the "User"). Anthony Garçon sells the Products presented on the Site exclusively at retail and to end consumers, excluding any resale for professional purposes.
Sales made in Anthony Garçon stores are not governed by these General Terms and Conditions.
For the purposes of these terms, Anthony Garçon and the User are collectively referred to as the "Parties" and individually as a "Party." The User who has validated an order is referred to as the "Buyer." The rights and obligations of the User automatically apply to the Buyer.
The User declares that they are of legal age and have full legal capacity, or have the authorization of a person holding parental authority, a guardian, or a curator.
Any order for a Product on the Site implies the prior and express consultation and acceptance of these General Terms and Conditions, signified by checking a box. They are accessible at any time on the Site and prevail over any other document.
Unless proven otherwise, the data recorded by Anthony Garçon on the Site constitutes proof of all transactions made between the Parties.
Anthony Garçon reserves the right to update these General Terms and Conditions at any time. The terms applicable to the Buyer are those in effect on the day of their order. The User may save or print these terms without modifying them.
ARTICLE 1. PURPOSE
These General Terms and Conditions define the rights and obligations of the Parties in the context of the online sale of Products offered on the Site. They govern all stages of the order, from placement to delivery or collection.
Made-to-measure services, offered exclusively in-store and by appointment, are not sold on the Site and are not governed by these General Terms and Conditions.
ARTICLE 2. PRODUCTS, PRICES AND TAX-FREE SHOPPING
2.1. Products
The Products offered for sale are those appearing on the Site on the day of consultation by the User, within the limits of available stocks.
In the event of a Product becoming unavailable after an order has been placed, the Buyer will be informed by email. The unavailable Product will then be cancelled and refunded, with the rest of the order remaining firm and final.
2.2. Product information
In accordance with Article L. 111-1 of the French Consumer Code, the User may read the essential characteristics of each Product on its descriptive page before ordering. For any further information, they may contact Customer Service (Article 9).
Anthony Garçon takes the greatest care in presenting the Products, particularly regarding the accuracy of colors. However, depending on the browser and screen used, the colors displayed may differ slightly from those of the actual Products.
Users who notice an error or omission in a description may inform Customer Service, which will proceed to correct it as soon as possible.
2.3. Prices
Prices are indicated in euros, inclusive of all taxes (TTC), including French VAT, subject to Article 2.4. Products are invoiced at the prices displayed on the Site at the time the order is validated.
Prices do not include delivery charges, which are indicated to the User before the final validation of their order.
Anthony Garçon reserves the right to change its prices at any time. Products are invoiced based on the prices in effect at the time the order is validated.
2.4. Orders delivered outside the European Union and tax-free shopping
Orders placed by a Buyer residing outside the European Union and delivered outside the European Union are invoiced excluding taxes (HT). The HT price is automatically displayed at checkout, with no action required from the Buyer. Customs duties and local taxes of the destination country remain the Buyer's responsibility (Article 5.6).
However, tax-free shopping (VAT refund for travelers residing outside the European Union, by means of an export sales slip) is not available for orders placed on the Site, even when they are picked up in-store.
Travelers wishing to benefit from tax-free shopping are invited to make their purchases directly in-store, subject to current eligibility conditions.
ARTICLE 3. ORDERING PROCEDURE
3.1. Navigation
The User may freely browse the Products and the various pages of the Site without being bound by an order.
3.2. Customer account
The User may order by creating a customer account or by entering their information directly at the time of ordering.
When creating an account, the User accurately provides their identification information, including their surname and first name, email address, telephone number, and postal address. They are solely responsible for the confidentiality of their login credentials and their use. In case of loss or forgetting, they can obtain new ones from the login page.
The User may agree to receive newsletters and commercial information from Anthony Garçon by email.
The User has the right to register free of charge on the Bloctel list opposing cold calling, on the website www.bloctel.gouv.fr.
3.3. Product selection
The User selects the Products they are interested in by clicking "Add to cart." At any time, they may view their cart, continue shopping, or proceed to payment.
Before validating their order, the User chooses their delivery or collection method, then a summary is displayed: nature, quantity, and price of the Products, User contact details, delivery address or store for collection, delivery time and charges, and total amount.
3.4. Order validation
After checking the details of their order, the User accepts these General Terms and Conditions by checking the box provided for this purpose, then clicks on the payment button. This validation constitutes unreserved acceptance of the General Terms and Conditions and creates an obligation to pay.
Once the payment is accepted, the order is recorded in Anthony Garçon's IT systems, kept on a reliable and durable medium, which serves as proof of the contractual relationship between the Parties. The User then becomes the Buyer.
3.5. Order confirmation
A confirmation email summarizing the order and the delivery time is sent to the Buyer. Anthony Garçon recommends keeping it. A summary is also available in the customer account.
ARTICLE 4. PAYMENT
4.1. Order amount
The amount due by the Buyer is indicated before the validation of their order.
4.2. Payment methods
Payment is made online at the time of ordering by credit card (Visa, Mastercard, American Express, Diners Club, Discover, JCB), PayPal, Apple Pay, Google Pay, or Amazon Pay. All payments are secure.
4.3. Payment in installments with Alma
Payment in three (3) or four (4) interest-free installments is offered via our partner Alma for any purchase of €300 or more. Payments are secured by Alma and protected by the 3D Secure protocol.
Alma issues an electronic certificate that serves as proof of the amount and date of the transaction. The termination of these General Terms and Conditions entails the termination of the general terms of use binding Alma and the Buyer.
4.4. Payment confirmation
The order is validated after payment is approved. In case of refusal, it is automatically cancelled.
Anthony Garçon reserves the right to refuse any order or delivery in the event of an existing dispute with the Buyer, total or partial non-payment of a previous order, or refusal of payment authorization.
4.5. Order verification
In order to prevent any fraudulent use of payment methods, Anthony Garçon may ask the Buyer for an order exceeding €2,000 to provide a copy of their identity document and a proof of address less than three (3) months old, to be sent by email.
The order is shipped after receipt and verification of these documents. Failing receipt or in the event of non-compliant documents, Anthony Garçon may cancel and refund the order.

5.3. Delivery times and charges
Anthony Garçon undertakes to deliver the Products no later than seven (7) working days after validation of the order for France, including overseas departments and regions, and ten (10) working days for the European Union.
For Canada and the United States, the delivery time depends on the carrier and the customs formalities of the destination country. An estimated time is provided to the Buyer before validation of their order.
The applicable time frame is indicated before order validation and stated in the confirmation email.
Delivery charges depend on the weight of the order and the destination country. They are calculated by the Site's simulator and indicated before order validation. Delivery is free in mainland France for any order of €300 or more.
5.4. In-store pickup (click & collect)
The Buyer may choose to collect their order free of charge at the Anthony Garçon Malesherbes boutique, 37 boulevard Malesherbes, 75008 Paris. This option is not available in other stores.
The Buyer is informed by email as soon as their order is available. They collect it upon presentation of an identity document and their order confirmation, within a period of two (2) months. After this period, the order may be cancelled and refunded.
Collecting an order placed on the Site in-store does not allow for tax-free benefits (Article 2.4).
5.5. Absence during delivery
In case of absence, the carrier leaves a delivery notice. The Buyer must then collect their parcel at the indicated post office within two (2) weeks, with an identity document.
If the parcel is not collected, it is returned to Anthony Garçon, which will offer the Buyer reshipment at the cost of a new shipment. If the Buyer does not wish to have it redelivered, they will be refunded the price of the Products, with the initial delivery charges remaining at their expense.
Delivery is deemed to have taken place when the parcel is handed to the Buyer, in their mailbox, at the post office, or in-store, with the carrier's proof of delivery serving as evidence.
5.6. Customs duties
Any order shipped outside the European Union may be subject to customs duties and local taxes, payable by the Buyer. It is the Buyer's responsibility to check with the competent authorities of the country of delivery.
5.7. Receipt and reservations
The Buyer checks the condition of the parcel and the conformity of the Products upon delivery. In the event of a damaged or opened parcel, they must express their reservations to the carrier at the time of delivery, then report them to Customer Service (Article 9) as soon as possible.
Anthony Garçon undertakes to refund or exchange Products that do not conform to the order. The Buyer returns them according to the procedure described in Article 6, without prejudice to the statutory warranties (Article 8).
ARTICLE 6. RIGHT OF WITHDRAWAL AND RETURNS
6.1. Withdrawal period
The Buyer has a period of fourteen (14) days from receipt of their order, or its collection in-store, to exercise their right of withdrawal, without having to justify a reason.
6.2. Exercising the right of withdrawal
To withdraw, the Buyer notifies their decision to Anthony Garçon before the expiration of this period:
- by an unambiguous statement addressed to Customer Service, by post or by email;
- using the withdrawal form appearing in Annex 1, also downloadable on the Site;
- by completing the return slip included with their parcel, which details the return procedure and allows them to request a refund for their order.
6.3. Returning Products
The Buyer returns the Products to the address provided by Customer Service, no later than fourteen (14) days after notifying their withdrawal. The costs and risks of the return are at the Buyer's expense.
Products must be returned new, in their original condition, unworn, unwashed, unironed, with their labels and accessories, accompanied by the return number provided by Anthony Garçon. A parcel without any element allowing the identification of the Buyer cannot be processed.
The Buyer's liability may be incurred in the event of depreciation of the Products resulting from handling other than that necessary to establish their nature, characteristics, and proper functioning.
Returns, exchanges, and refunds for orders placed on the Site cannot be made in-store.
6.4. Refund
Anthony Garçon refunds all sums paid, including initial delivery charges up to the limit of the standard delivery method, no later than fourteen (14) days after having been informed of the withdrawal. The refund may be deferred until the Products are recovered or until proof of their shipment by the Buyer is provided.
The refund is made using the payment method used during the order, unless otherwise agreed by the Buyer.
6.5. Exceptions
In accordance with Article L. 221-28 of the French Consumer Code, the right of withdrawal does not apply to Products made according to the Buyer's specifications or clearly personalized.
ARTICLE 7. EXCHANGES
The Buyer may request an exchange of all or part of the Products in their order within fourteen (14) days from their receipt. The exchange may be for a different size, subject to availability, or for another Product of equal or greater value.
The exchange follows the same procedure as the return (Article 6). The reshipment costs for the new Products are at the Buyer's expense. The delivery time for replacement Products is that of a standard order (Article 5).
ARTICLE 8. STATUTORY WARRANTIES
Independently of any commercial warranty, Anthony Garçon is bound by the statutory warranty of conformity provided for in Articles L. 217-3 et seq. of the Consumer Code and the warranty against hidden defects provided for in Articles 1641 et seq. of the Civil Code. Any request under these warranties must be addressed to Customer Service (Article 9).
8.1. Statutory warranty of conformity
The Buyer has a period of two (2) years from the delivery of the Product to act. During this period, they are only required to establish the existence of the lack of conformity, and not the date of its appearance.
The Buyer may choose between repair or replacement of the Product, unless the chosen option entails a cost that is clearly disproportionate compared to the other. If compliance is impossible or does not occur within thirty (30) days, they may obtain a price reduction or rescission of the sale.
The implementation of the statutory warranty of conformity involves no cost to the Buyer.
8.2. Warranty against hidden defects
The Buyer may enforce the warranty against hidden defects within a period of two (2) years from the discovery of the defect. They may then choose between the rescission of the sale, with restitution of the price, or a reduction of the price, in accordance with Article 1644 of the Civil Code.
